2. This modification application has been filed for modification of the order dated 16.04.2025 passed by this Court in Cr. Misc. No.19001 of 2025 by which the petitioner was granted privilege of anticipatory bail in Fatuha PS Case No.209 of 2024 subject to payment of 50% of the fine imposed on Pocklen Excavator Tata Hitachi (Company) seized in connection with aforesaid case before furnishing bail bonds.

3. Learned counsel for the petitioner submits that eight weeks time was granted to the petitioner to surrender before the Court below in compliance of the order dated 16.04.2025 passed in Cr. Misc. No.19001 of 2025 subject to

Patna High Court CR. MISC. No.45714 of 2025(2) dt.11-07-2025 2/2 payment of 50% of the fine, but the petitioner could not arrange the money to deposit the fine within time and as such petitioner could not surrender in the Court below in time. Now, the petitioner has deposited fifty percent of the fine in the office of the District Mining Officer, Patna, on 16.06.2025, vide Annexure-2. Learned counsel further prays that period fixed in the order dated 16.04.2025 passed in Cr. Misc. No.19001 of 2025 may be extended so that the petitioner may furnish bail bonds.

4. Having heard learned counsel for the parties, two weeks' further time from the date of receipt/production of a copy of this order is granted to the petitioner to surrender in the Court below in compliance of the order dated 16.04.2025 passed in Cr. Misc. No.19001 of 2025.

5. Let this order be communicated to the ACJM- II, Patna City, Patna, in connection with Fatuha PS Case No.209 of 2024.
