The petitioner is apprehending his arrest in Lodipur P.S.Case No.60 of 2016 registered for the offences under Sections 341, 342, 323, 364, 365, 379 and 34 of the Indian Penal Code. According to the F.I.R.Md. Ganno attempted to kidnap the informant. However, Md. Ganno was apprehended at the spot and petitioner had fled away.
Submission of the learned counsel for the petitioner is that the case diary would reveal that the witnesses have deposed about the occurrence of simple assault only due to political rivalry and the co-accused was apprehended. Further submission is that the petitioner has got no criminal antecedent.
Patna High Court Cr.Misc. No.18676 of 2017 (3) dt.29-06-2017 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., 4th Bhagalpur, in Lodipur P.S. Case No.60 of 2016 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
