JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-05-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. Petitioner is apprehending his arrest in connection with Brahmpur (Krishna Brahm) PS case no. 82 of 2017 registered for the offences punishable under Sections 341, 323, 307, 379, 447, 504/34 of Indian Penal Code.
During course of hearing, it transpires that there is family dispute between the parties. Learned counsel for informant admits that partition suit is pending between the parties. By way of supplementary affidavit, petitioner has placed on record the injury report which shows that the injury is simple in nature. In view of the facts and circumstances mentioned above, let the petitioner, in the event of his arrest or surrender
Patna High Court Cr.Misc. No.19865 of 2017 (3) dt.31-05-2017 2/2 within four weeks from the date of receipt/ production of a copy of this order, be released on bail on his furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar or successor Court in Brahmpur (Krishna Brahm) PS case no. 82 of 2017 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
