It appears from the record that the petitioners filed Cr. Misc. No. 55759 of 2015 with a prayer for anticipatory bail in Complaint Case No. 9955 of 2014 pending in the court of learned CJM, Madhubani, wherein process was directed to be issued after cognizance being taken under section 420 IPC but it appears that the main order discusses with regard to facts of some other case under section 387 IPC. From the progress entry of the Court master, it appears that the matter was passed over on 16.12.2015 but by incorporating wrong facts the application was directed to be
Patna High Court Cr.Misc. No.4175 of 2016 (2) dt.10-02-2016 2/2 disposed of and the order was inadvertently pronounced. In the circumstances, the order dated 16.12.2015 passed in Cr. Misc. No. 55759 of 2015 is hereby rescinded. The order dated 16.12.2015 passed in Cr. Misc. No. 55759 of 2015 be off-loaded from the website as well as from the internal computer records.
Let no certified copy of the said order be issued. Since the matter relates to anticipatory bail of 2015 and this court has roaster of 2016 anticipatory bail, let Cr. Misc. No. 55759 of 2015 be placed before the appropriate bench under the orders of Hon'ble the Chief Justice.
Accordingly, this modification application stands disposed of.
