JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Begusarai Nagar (Town) P.S. Case No. 544 of 2016 for the offences punishable under section 363, 366(A) of the Indian Penal Code and subsequently added under section 8 of the POSCO Act. In paragraph 3 of the petition, the petitioner has stated that he has clean antecedent.

The victim girl in her statement recorded under section 164 Cr.P.C. has stated that due to family dispute, she left for Delhi where she stayed with her elder mother. Later on, she returned back to Barauni and in her statement she has stated that she is willing to stay with her parents. There is no allegation levelled by the victim against the petitioner in her statement recorded under section 164 Cr.P.C.

Case No 544 of 2016, subject to the condition as laid down under section 438 (2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
