The petitioner who is in custody since 07.04.2019 has filed the instant application for grant of bail in connection with Falka P.S. Case No. 111 of 2019 (District- Katihar) registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act.

As per the allegation in the FIR, on search, a loaded country made pistol and some live cartridges were recovered from the possession of the petitioner and thereafter the petitioner and some other accused persons were arrested. It is submitted by learned counsel for the petitioner that similarly situated co-accused has been enlarged on bail vide order dated 17.07.2019 passed in Cr.Misc. No.42687 of 2019.

No.44646 of 2019(3) dt.16-10-2019 2/2 The petitioner is in custody since 07.04.2019 and it has further been submitted that contrary to the allegation no incriminating article has been recovered from the possession of the petitioner. The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact that the similarly co-accused has been enlarged on bail and the petitioner is in custody since 07.04.2019, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate,Vth, Katihar in connection with Falka P.S. Case No. 111 of 2019 (District -Katihar).
