The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 504, 506, 354(B), 379 and 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that on 06.02.2021, the accused persons including the petitioner entered her house and thereafter, the petitioner attacked the complainant with bamboos, sticks injured her both hands and when she fell on the ground, it is alleged that Babloo Paswan also assaulted her. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. From bare perusal of the allegation as alleged in the F.I.R., it would manifest

No.54418 of 2021(2) dt.25-07-2022 2/2 that the allegation of assault is on the non-vital part of the body and the injury is simple in nature and it is next submitted that petitioner came to be falsely implicated as the wife of the petitioner had instituted Gogri P. S. Case No.226 of 2020 and Gogri P. S. Case No.57 of 2021 against the informant and others. The learned Additional Public Prosecutor opposes the anticipatory bail application.
Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gogari P. S. Case No.56 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
