JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 03-11-2017 Heard Mr. Arun Kumar, learned counsel for the petitioner and Mr. Ajay Bihari Sinha, learned GA-8. The present Writ application has been filed for directing and commanding upon the respondent authorities to create Jamabandi with regard to the land appertaining to C.S.P. No. 279 and 282, Khata No. 157, Thana No. 697 situated in Village - Dhobhan, P.S. and Anchal - Musahari, District - Muzaffarpur.
It is submitted by learned counsel for the petitioner that the Circle Officer, Musahari has rejected the claim of the petitioner on the ground that in R.S. Khatiyan the land in
Patna High Court CWJC No.5886 of 2015 (3) dt.03-11-2017 2/2 question is recorded in the name of State of Bihar, However, the necessary correction in the Khatiyan has been made by the consolidation authority.
Learned GA-8 submits that against the order of Circle Officer, Musahari Appeal No. 612 of 2012 is pending. Moreover, with regard to same cause of action Title Suit No. 02 of 2013 is also pending.
In view of the above factual position, the Writ application is misconceived and accordingly, it is disposed of. (Dinesh Kumar Singh, J) DKS/- U
