The petitioner apprehends his arrest in Town P.S. Case No.260 of 2019 registered under Sections 341, 323, 307, 354, 504 and 506 of the Indian Penal Code.

The informant is the wife of the petitioner. The informant made allegation that her husband had kept a concubine and he was living with her. Informant caught them in the house of concubine but they assaulted her. The learned counsel for the petitioner submits that the wife of the petitioner made false and frivolous allegation. Petitioner never subjected his wife to any sorts of physical or mental torture. The lady who is alleged to have been kept by the petitioner has not made any allegation against the petitioner.

Taking into consideration the facts aforesaid and the nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S.
