Petitioner seeks bail in Falka P.S. Case No.111 of 2019 instituted for the offence under Section(s) 399, 402 Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. It is alleged that one loaded country made pistol, two cartridges and two mobiles have been recovered from possession of the petitioner.

Counsel for the petitioner submits that Petitioner is in custody since 07.04.2019 having clean antecedents. It is also submitted that another co-accused, Shankar Dayal Singh, has already been granted regular bail by this Court by order dated 26.06.2019 passed in Cr. Misc. No.37882 of 2019.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, V, Katihar, in connection with Falka P.S. Case No.111 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
