JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-11-2018 In view of para-3 of the reply to the second supplementary counter affidavit, the writ petition is disposed of with direction to the District Programme Officer (Establishment), Saran at Chapra to examine the contents of the para-3 of the reply to the second supplementary counter affidavit and extend similar benefit to the petitioner following the judgment of the full bench reported in 2018 (2) PLJR 929 or take corrective measure with regard to all those were continuing on the strength teachers training degree from Sister Nivedita Teachers Training College, Kolkata after giving opportunity of hearing as respondent cannot adopt two different

If the petitioner and others have obtained teachers training from the same institution either the degree is a valid degree or if it is invalid the benefit of such invalid degree cannot be extended to blue eyed and this petitioner cannot be discriminated.

Necessary decision in this regard may be taken by the District Programme Officer (Establishment), Saran at Chapra within a maximum period of four months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
