JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Manjhi P.S. Case No. 168 of 2016 registered for the offences punishable under Sections 147, 148, 323, 379, 324, 307 of the Indian Penal Code.

Allegedly, the petitioners and other FIR named accused persons came at the house of the informant, abused him and started assaulting, when the brother Brighunath and Panchanan Thakur came for rescue then, they were also assaulted and injured and in the meantime the ear ring and mangalsutra were also snatched.

Submission is of false implication and that due to land dispute the occurrence has taken place, against the petitioners

Patna High Court Cr.Misc. No.881 of 2017 (2) dt.12-01-2017 there is no specific allegation and as such the petitioners deserve sympathetic consideration.

Learned APP opposes the prayer of bail.

In the facts and circumstances stated above, considering that against the petitioners there is no specific allegation and petitioner no. 1 is lady, the petitioners above named, in case of their surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 5th, Saran at Chapra in connection with Manjhi P.S. Case No. 168 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
