JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Dhoraiya P. S. Case No.247 of 2018 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.
Prosecution story as per FIR is that minor daughter of informant went for tuition and it is alleged that son of the petitioners enticed her away for the purpose of marriage and for that informant went to the house of petitioner to inquire about his daughter but they had not co-operate the informant and he suspects their hands also.
Submission of learned counsel for the petitioners is that FIR itself shows that the girl is aged 17 years and she fled

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that the girl is still traceless. In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Dhoraiya P.S. Case No. 247 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
