Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 76, 303(2), 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that accused persons, including the petitioner, assaulted her son on order of Laxmi, as on query about the tractor, the informant said that she was not aware that who took the tractor from the field of the petitioner, further the petitioner dashed the informant on ground and disrobed her.

The learned counsel for the petitioner submits that on account of dispute relating to land, the occurrence is alleged to have taken place in which both sides assaulted each other. It is also submitted that from the side of the petitioner Narpatganj PS Case No. 11 of 2025 has been instituted by father of the petitioner alleging that Ajay assaulted the petitioner and his brother causing injury. It is next submitted that brother of the present petitioner suffered two grievous injuries on head and leg, as would manifest from Annexure-4/1 to the anticipatory bail application. It is further submitted that the present informant is mother of Ajay and instant FIR is Narpatganj PS Case No. 24 of 2025, as such the instant case was instituted by way of counter blast. It is also submitted that brother of the petitioner has suffered grievous injury on account of assault made by Ajay, who is son of the present informant and the allegation of assault against this petitioner is not specific rather is alleged to have assaulted with Tara causing grievous injury to the son of the present informant.

The learned APP and learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that the

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Narpatganj P.S. Case No. 24 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
