The appellants seek pre-arrest bail in connection with Khajelakan P.S. Case No.416 of 2019 registered under Sections 147, 148, 149, 341, 323, 448, 379, 504, 354 and 506 of the Indian Penal Code and Section 3(1)(r)2(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Learned counsel for the appellants submits that the appellants have committed no offence and have falsely been
Patna High Court CR. APP (SJ) No.3949 of 2021(2) dt.25-10-2021 2/2 implicated in the present case. Similarly situated co-accused, namely, Vivek Yadav @ Bibek Yadav and Vikash Yadav @ Bikash Yadav have already been granted anticipatory bail by a coordinate bench of this Court vide order dated 15.01.2021 passed in Cr.Appeal (SJ) No.626 of 2020. The case of the appellants stands on the same footing. The appellants have got no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named appellants be released on bail, in the event of arrest or surrender, on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. VIII-cumSpecial Judge, SC/ST Act, Patna in connection with Khajelakan P.S. Case No.416 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Accordingly, the appeal is allowed and the impugned order dated 23.01.2020 is set aside.
