Petitioner apprehends his arrest in a case registered for the offence punishable under Section 341, 323, 420 of the Indian Penal Code.

As per the prosecution case, this petitioner took Rs. 10,000,00/- from the informant for selling a piece of land but neither he executed sale deed nor returned the money. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that through there is allegation that petitioner took Rs. 10,000,00/- from the informant but no chit of paper has been annexed in support of the allegation. Petitioner has never taken any money from the informant. The dispute

Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail and submitted that petitioner took Rs ten lakh from the informant but neither he executed the sale deed nor returned the money. Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, East Champaran, Motihari in connection with Sangrampur PS case No. 17/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
