JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2017 Heard learned counsel for the petitioners and learned counsel representing the State.
The petitioners seek bail in connection with Alauli P.S. Case No. 34 of 2016 registered for the offences punishable under Sections 406, 467, 468, 471, 420, 120B, 419 of the Indian Penal Code.
Allegedly, under criminal conspiracy the petitioners and co-accused got executed the sale deed for the land of the informant in favour of Amit Kumar knowing well that the executant of the sale deed had lost the case before the D.C.L.R., Khagaria on 07.09.2011. The petitioners have intentionally sold the land of the informant to the co-accused having no right and title over the same.
Patna High Court Cr.Misc. No.4000 of 2017 (2) dt.17-02-2017 Submission is of false implication and that due to land dispute and village politics the petitioners have been implicated in this case, the petitioners are bonafide sellers of land of their own share as such no case is made out against them. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering the land dispute between the parties and further considering the nature of dispute, the petitioners above named, in case of their surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 34 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
