JUSTICE SANJAY PRIYA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 406, 420, 467, 471, 120(B)/34 of the Indian Penal Code.

It is alleged by the Complainant that by impersonating her in the registry office, the accused person got executed a sale deed with respect to her land. The petitioner is the purchaser and accused Nos. 2 and 3 are identifiers of the aforesaid sale deed. It has been submitted on behalf of the petitioner that he has purchased the land of Kalawati Devi after giving proper consideration. Later on it has come to his knowledge that the said lady was not Kalawati Devi rather she was Sudama Devi. It has further been submitted that the petitioner has been cheated by

Patna High Court Cr.Misc. No.1626 of 2017 (2) dt.19-01-2017 2/2 Ramautar Yadav, Manoj Yadav and Sudama Devi for which he has filed a case against them vide Complaint Case No. 2303C of 2016 before the Chief Judicial Magistrate, Araria. In this manner, there is a civil dispute between the parties. Considering the aforesaid facts and circumstances of the case, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Forbesganj P.S. Case No. 394 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
