The petitioner who is in custody since 23.04.2019 has filed the instant application for grant of bail in connection with Azamnagar P.S. Case No. 236 of 2016 registered for the offence punishable under sections 302, 307 and 34 of the Indian Penal Code.

As per the allegation in the FIR, the petitioner is said to be the driver of the vehicle by which other nine named accused persons came to the place of occurrence. Suresh Mandal and Baijnath Mandal are alleged to have fired hitting the brother of the informant and one Md. Tanweer. It is submitted by learned counsel for the petitioner that no overt act has been alleged against this petitioner who

Patna High Court CR. MISC. No.41441 of 2019(3) dt.13-09-2019 2/2 has no criminal antecedent and is in custody since 23.04.2019. It is further submitted that other co-accused persons have been enlarged on bail, details of which has been given in paragraph 13 of the bail application.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Katihar in connection with Azamnagar P.S.
