Petitioner seeks regular bail in connection with Marauna PS Case No. 55/2021 registered for the offence punishable under Sections 25(1-b)a/26 of the Arms Act. The police, allegedly, recovered one pistol along with five live cartridges from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to village dispute. He next submits that the petitioner is in custody since 19.05.2021 having no criminal antecedent and there is no likelihood that the petitioner will abscond or tamper with the

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 19.05.2021 having no criminal antecedent and there is no likelihood that the petitioner will abscond or will tamper with the evidences, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, BIJENDRA PRASAD YADAV be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Supaul in connection with Marauna PS Case No. 55/2021.
