2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 326, 307, 354(B), 379 of the Indian Penal Code.
3. It is a case of trying to outrage the modesty of the informant's aunt and on protest petitioner assaulted her and snatched her chain. On gathering of local people, they caught hold the petitioner and handed him over to the police.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is young boy of 21 years and victim lady is aged about 60 years. Due to demand of labour payment, petitioner has been dragged in the false case. Petitioner has got no criminal antecedent and
Patna High Court CR. MISC. No.44799 of 2023(2) dt.28-07-2023 2/2 languishing in judicial custody since 30.01.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 1st Class, Judicial Magistrate, Katihar in connection with Pranpur P.S. Case No. 19 of 2023.
