The petitioner seeks bail in anticipation of his arrest in connection with Banshi P.S. Case No. 37 of 2018, dated 18.09.2018, instituted for the offences under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

The petitioner is said to have assaulted the informant by means of a hard and blunt substance on his

It has been submitted on behalf of the petitioner that there is an admitted land dispute between the parties. It has further been submitted that the son of the petitioner has also filed a case against the informant of the present case and others vide Banshi P.S. Case No. 38 of 2018. The investigation against the petitioner is complete and charge-sheet has been submitted vide Charge-Sheet No. 68 of 2018.

The occurrence is said to have taken place over the dispute regarding uprooting of tapioca from the field over which there is competing claim.

Taking into account the frivolous nature of dispute between the parties and because of the intersession of local people, a settlement has been arrived at between the parties and the informant now does not wish to prosecute the petitioner any further.

Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is

No.16102 of 2021(2) dt.04-03-2022 3/3 directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Arwal in connection with Banshi P.S. Case No. 37 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
