Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 7.11.2017 passed in Cr. Appeal (S.J.). No. 3082 of 2017 on merit.

Heard learned A.P.P. also.

Having heard both sides, this application is disposed of with direction to the appellant to surrender with a bank draft of 50 % of the payable amount, however, it appears that the direction has not been complied.

It is submitted that now they are ready to compromise the case.

In such view of the matter, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender

Patna High Court CR. APP (SJ) No.404 of 2018 (5) dt.02-05-2018 2/2 along with bank draft of the aforesaid amount and if the same is deposited or any compromise has been reached between the parties and the learned court below is satisfied, he will pass appropriate order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
