The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201, 34 of the Indian Penal Code.

Allegation against the petitioner that he along with other co-accused persons brought the informant's son to Patna on the pretext of birthday party and committed his murder. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During investigation, there is no consistent evidence of commission of murder found against the petitioner rather only on the basis of suspicion that the deceased informed before leaving house that he was going to

Patna High Court CR. MISC. No.44181 of 2022(3) dt.09-01-2023 2/2 attend the birthday party with his friends/petitioner, the F.I.R. has been lodged against the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 8.3.2021.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khagaul P.S. Case No. 179 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Danapur.
