JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Rahui (Bhagan Bigha) P.S. Case No. 150 of 2011, registered under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioners submits that it would appear from the F.I.R. that petitioner no. 1 is the son-in-law of the informant and the petitioner no. 2 is the brother of petitioner no. 1 and mere on suspicion, petitioners and three others named in the F.I.R. have been made accused mere on suspicion because

Moreover, after investigation, the police submitted the final form against the petitioners and others while submitting charge sheet against one Suryamani @ Bhuni @ Manoj Paswan. After the commitment of the case to the court of Session during trial petitioners have been summoned under Section 319 Cr.P.C. on the basis of suspicion raised by four witnesses.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, Nalanda at Bihar Sharif, in connection with S. Tr. No. 478 of 2014 arising out of Rahui (Bhagan Bigha) P.S. Case No. 150 of 2011, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
