2. The petitioner seeks regular bail in connection with Ara Town P.S. Case No. 148 of 2023, registered for the offence punishable under Sections 379/307/34 of the Indian Penal Code.

3. As per prosecution case, the informant was caught by three named criminals and on the point of pistol they took the gold chain and Rs. 30,000/- cash. The informant tried to protest Uttam Kumar, shot on the informant which hits him on the chest.

4. Learned counsel for the petitioner submits that the petitioner and informant are neighbour and the petitioner has falsely been implicated in this case. The petitioner is accused in one case under Section 307/384/504/34 of the Indian Penal

Patna High Court CR. MISC. No.45713 of 2023(2) dt.28-07-2023 2/2 Code and section 27 of the Arms Act. Petitioner is in custody since 24.02.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact and also considering the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail after completing nine months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Town P.S. Case No. 148 of 2023.
