2. The petitioner apprehends arrest in connection with Shikarpur PS Case No.941 of 2024 dated 16.12.2024, instituted under Sections 126(2), 115(2), 110, 351(2), 352, 3(5), 109 of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he assaulted the son of the informant on his head due to which he sustained injury on head, shoulder and hand.

4. Learned counsel for the petitioner submits that there is specific allegation against the informant that he assaulted the son of the informant, who sustained head injury, however, the doctor has opined the nature of the injury as

Counter case has been lodged by Smita Kumari, who is the family member of the petitioner, against the informant and others vide Shikarpur PS Case No.956 of 2024 for the offence under Sections 126(2), 1155(2), 110, 74, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. Lastly, it is submitted that one criminal case is pending against the petitioner.

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in Shikarpur PS Case No.941 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
