This is a petition for grant of anticipatory bail for offence under Sections 272 and 273 of the Indian Penal Code and 47 of the Excise Act.
From beneath the stairs of the house of the petitioner, liquor was allegedly recovered.
Submission of the petitioner is that the recovery was made on 26.09.2016 not from conscious possession of the petitioner rather the house is occupied by other family members.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Isuapur P.S. Case No. 135 of 2016 to the satisfaction of the Additional Chief Judicial
Patna High Court Cr.Misc. No.4043 of 2017 (3) dt.24-03-2017 2/2 Magistrate, Vi, Saran at Chapra, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
