2. The petitioner seeks bail in connection with Bahadurganj P.S. Case No. 258 of 2024 registered for the offence under Sections 365, 376(2)(n), 328, 323 and 506 of the Indian Penal Code.

3. As per the prosecution case, the petitioner has committed sexual assault with the victim after taking her to Kerala in a train.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The case arises out of a complaint case, and the complaint case was registered after a delay of two and a half months of the occurrence.

5. Learned counsel for the petitioner further submits that the petitioner is in custody since 11.11.2024.

6. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 1st Kishanganj/concerned Court below in connection with Bahadurganj P.S. Case No. 258 of 2024.
