2. The writ petition has been filed for the following reliefs :- I. For issuance of an appropriate writ/writs for direction upon Respondent authorities to pay the entire outstanding dues of arrears difference of

2/4 salaries of the aforesaid petitioner who had already retired recently on 31.03.2026 as Associate Professor, Department of Hindi, M.A.M. College, Naugachia, Bhagalpur. Her arrears difference of salaries dues amount remained unpaid which is payable to the petitioner for the period from (a) March 1988 to December 2005 total amounting Rs.106284/-.

(b) For the period from January 2006 to December 2015 total amounting Rs.1594137/- (Fifteen lacs Ninety Four Thousand one Hundred Thirty seven only).

(c) For the period from January 2016 to March 2019, total amounting Rs.856520/-. The petitioner's net claim is required to be paid by the university with all consequential benefits till date. The Respondent college has already sent the claims of arrears statement of difference of salaries amount to the university authorities for the period from March 1988 to December 2005, January 2006 to December 2015 and January 2016 to March 2019 but till date no payment has been made to the petitioner aforesaid. - Arrears statement of difference of salaries is enclosed as Annexure-4series alongwith statutory interest. II. For grant of any other relief/reliefs for which the petitioner is entitled under law as well as the facts and circumstances of the case.

3. Learned counsel for the petitioner submits that the petitioner was appointed on the post of Lecturer (Hindi) Madan Ahilya Mahila (M.A.M.) College Naugachia on 05.11.1986 vide Notification No.16/06/05 and the petitioner's services is said to have been absorbed in view of the recommendation made by the Committee so constituted, as per the decision of the Syndicate of

3/4 the University, and as also the recommendation of the Hon'ble Retired Justice S.C. Agarwal, so constituted by the Hon'ble Apex Court in Civil Appeal No.6098 of 1997.

4. It is the case of the petitioner that for adjudicating the grievances, as mentioned in paragraph 1 of the relief portion of the writ petition, a detailed representation has already been made before the Respondent No.3, The Registrar, Tilka Manjhi Bhagalpur University, Bhagalpur.

On the other hand, Ms.Anita Kumari, who appears for the Tilka Manjhi Bhagalpur University, Bhagalpur, submits that appropriate directions may be issued to the petitioner to file a detailed representation appending all documents to ventilate her grievance and on filing of such representation, Registrar may be directed to adjudicate the grievances, by taking a final decision on the representation so filed through a reasoned and a speaking order.

Considering the stand of the parties, this Court directs the petitioner to file detailed representation within a period of two weeks appending all supportive material / documents, and the grievances of the petitioner shall be adjudicated within a period of three months from the date of filing of representation.

It is made clear that the Registrar, Tilka Manjhi Bhagalpur University, Bhagalpur, shall take all necessary steps to comply with and give effect of the order passed in this case, keeping in row the fact that the petitioner has already superannuated from service. In the event of any failure on the part of the Registrar of the University, compelling the petitioner to initiate contempt proceedings, appropriate action shall be taken against the Registrar in accordance with law.
