JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Hilsa P.S. Case No. 559 of 2015, registered under Sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, one looted mobile is said to be recovered from the possession of co-accused Dhananjay Prasad, who disclosed before the Police that the said mobile was handed over to him by this petitioner, except the confessional statement, there is nothing against the petitioner to show his involvement in the present case. Further submission is that informant claimed to identify the culprits on seeing them

Patna High Court Cr.Misc. No.1905 of 2017 (2) dt.23-01-2017 2/2 again, but petitioner has not been put on TIP, while he is in custody since 26.10.2016. Further submission is that petitioner is accused in eight other cases, due to that reasons Police implicated the petitioner in the present case. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Hilsa in connection with Hilsa P.S. Case No. 559 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
