The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 363, 366, 354/34 of the Indian Penal Code.

Prosecution case in nutshell is that petitioner along with co-accused persons having arms in their hand entered into the house of the informant and tried to outrage the modesty of his daughter, namely, Surbhi Kumari, raised alarm then petitioner got up and entered in to the room where he saw that petitioner is trying to

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that petitioner is languishing in judicial custody since 11.05.2022. It is further submitted that petitioner never took away the victim girl from her house as alleged in FIR because there is a love affair between the petitioner and victim girl. She has not whispered anything regarding any illegal act done by the petitioner with her. Both parties are neighbors and in the background of old dispute, the present case has been registered with false allegation against the petitioner. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to

Case No. 257 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari.
