The petitioner seeks bail in anticipation of his arrest in connection with Bairiya P.S. Case No. 196 of 2020, dated 02.05.2020, instituted for the offences under Sections 341, 323, 353, 379, 386, 504, 506 and 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.39781 of 2020(2) dt.14-12-2021 2/3 It has been urged on behalf of the petitioner that he along with one Nandlal Yadav is said to have threatened the son of the informant on telephone.

Apart from this, it has been alleged in the F.I.R. that while the informant was going to his duty, the petitioner along with aforesaid Nandlal Yadav accosted him and coaccused/Nandlal Yadav divested him of his personal belongings.

It has been submitted on behalf of the petitioner that there is a dispute between the son of the Chawkidar and aforesaid Nandlal Yadav. The petitioner has been made accused in this case only because of his association with aforesaid Nandlal Yadav.

The earlier two cases in which the petitioner has been made accused and about which reference has been made in paragraph 3 of the bail application, he is on bail. Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in

No.39781 of 2020(2) dt.14-12-2021 3/3 the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Bairiya P.S. Case No. 196 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
