JUSTICE BIRENDRA KUMAR ORAL ORDER 17-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 447, 504, 506, 307 and 379 of the Indian Penal Code and 27 of the Arms Act.

The petitioners allegedly caused injuries at the head of the respective injured.

Submission of the learned counsel for the petitioners is that there is no allegation of repetition of blow and the doctor has found simple injury. Moreover, the present case is counter blast

Patna High Court Cr.Misc. No.3769 of 2017 (2) dt.17-02-2017 2/2 lodged by the petitioners' side. The present case was lodged after delay of eight days for which there is no explanation. The learned counsel for the informant has opposed the prayer for anticipatory bail.

Considering the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Nawadah/ Successor Court in connection with Akbarpur Police Station Case No109 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
