The petitioner apprehends his arrest in connection with L.N.M.U. P.S. Case No. 85 of 2015 registered under Sections 419, 420 and 120B of the Indian Penal Code.
The accusation is that on 19.03.2015 in the second shift of examination of Bihar Secondary School at Centre R.B. Jalan College, Bela, nine students had come to appear in the examination in place of other students, who were apprehended by the Examination Superintendent at the gate of the school. Learned counsel for the petitioner submits that it appears from the Admit Card of the petitioner which is at page 16 that the

No.2472 of 2017 (2) dt.07-03-2017 2/2 petitioner was the bona fide examinee of Matriculation Examination and on that date he had come for appearing in the said examination, but due to misconception, he was removed by the Examination Superintendent at the gate of the school. Further submission is that the petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with L.N.M.U. P.S. Case No. 85 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Vats/- U T
