JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Gandhi Maidan P.S. Case No. 369 of 2017 for the offence under Sections 409, 201 and 120(B)/34 of the Indian Penal Code.

The Assistant Regional Manager, Bihar State Roadways Transport Corporation lodged written report to the S.H.O., Gandhi Maidan alleging inter alia that incharge of Issue Department submitted a report that on different dates money of diesel has not been written in the Poddar Hand Book and as such the amount of sale of diesel was not deposited in the account of the Department.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. At the relevant time,

Patna High Court Cr.Misc. No.20731 of 2018(3) dt.10-12-2018 2/2 the petitioner was working as Cashier in Jan Nuram. He submits that the petitioner was superannuated on 31.01.2015 and thereafter he was re-engaged in Jan Nuram.

From perusal of the written report, it appears that there was no specific allegation against this petitioner. Altogether five persons have been named as accused in the instant case, out of which Raj Kumar Prasad, Nilmani Jha and Krishna Mohan Choudhary have already been granted anticipatory bail by different Co-ordinate Benches of this Court. Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. Case No. 369 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
