The petitioner seeks bail in a case registered under Section 395 of the I.P.C.

Allegation is that 10-12 unknown miscreants committed loot of jewellary of Rs.2.5 lacs, cash Rs.80000/, battery of mobile phone, CCTV and DVR etc. of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.7.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner. The petitioner

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge IIIcum-A.C.J.M., Patna in connection with Rajeev Nagar P.S. case No.149 of 2017.
