Permission is granted. 2 Counsel for the petitioner may implead District Magistrate, Patna as respondent No 6 to the instant writ petition during course of the day.
3 Heard learned counsel for the petitioner and the respondent-State.
Patna High Court CWJC No.18567 of 2015 dt.30-04-2018 2/2 4 Since the claim of the petitioner for compassionate appointment has been recommended by the office of the Commandant, BMP - V, Patna to the District Magistrate -cumChairman, District Compassionate Appointment Committee, Patna for consideration under Memo No 39 dated 06.01.2016 (Annexure H to the counter affidavit), the claim of the petitioner for compassionate appointment now has to be examined in light of the said recommendations.
5 In view of the said development, no useful purpose would be served to keep the instant writ petition pending. 6 This Court would only notice that recommendation, as contained in Annexure H is dated 05.01.2016. It is, therefore, expected that final decision on the said recommendation may be taken by the newly added respondent expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order. The claim of the petitioner should be disposed of in accordance with law within the period indicated hereinabove. 7 The writ petition is disposed of.
