The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 354(A), 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.
Allegation against the petitioners alongwith other accused persons is of assaulting the informant by iron-rod due to which the informant sustained injury. The other petitioners also snatched the silver chain from the wife of the informant. It has been submitted by learned counsel for the
Patna High Court CR. MISC. No.3461 of 2021(2) dt.18-11-2021 2/2 petitioners that the petitioners are innocent and have falsely been implicated in this case. Both parties are Gotia and there is land dispute between the parties. There is general and omnibus allegation against them and the injuries are simple in nature. It has further been submitted that there is case and counter case between the parties and petitioners have got no criminal antecedent, which is mentioned in para 3 of the bail application. Learned APP for the State vehemently opposed the prayer for bail of the petitioners.
In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Banka (Barahat) P.S. Case No. 917/2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
