Mr.Sri Amitesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-08-2022 Heard learned counsel for the petitioner and Mr. Amitesh Kumar, learned A.P.P. for the State.

After some argument, learned counsel for the petitioner himself comes out with a statement on instruction that the petitioner will pay the maintenance amount as awarded to his wife and the three minor children in terms of the judgment dated 28th July, 2017 passed by learned Principal Judge, Family Court, Madhepura. The operative part of the judgment reads as under:

" that the petitioner is entitled to get the maintenanceallowance to the tune of Rs. 2500/- for herself + Rs. 1500/-

Patna High Court CR. REV. No.365 of 2018(7) dt.12-08-2022 2/2 (Rs. 500/- each) for her three minor children, total Rs. 4,000/- from the OP. The O.P. is directed to pay such maintenanceallowance to the petitioner from the date of filing of this application i.e. 13.10.2014. Such maintenance-allowance shall be payable by 10th day of every succeeding English month, failing which the petitioner is entitled to recover the same through the process of law. Accordingly, this maintenance case is hereby allowed."

In view of the above statement, this revision application is being disposed of. The petitioner must comply with his undertaking within a period of three months from today, failing which it will be taken to be a case of contempt and the opposite party shall, besides taking steps for recovery of the amount in accordance with law, if so advised, move this court for initiation of a proceeding for contempt against the petitioner.
