Petitioner apprehends his arrest in connection with Amba P.S. Case No. 75 of 2015, registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Sections 8(15), C/29 of N.D.P.S. Act.
Allegation as per FIR is that two pickup vans were intercepted and huge quantity of Doda and Mahua flower were recovered and petitioner is said to be owner of the said vehicles. Submission of learned counsel for the petitioner is that he has no knowledge of carrying said articles in his vehicles and driver has done this without his permission, as such he is not responsible for that.
Heard learned APP also, who has opposed the prayer for
Patna High Court Cr.Misc. No.20137 of 2018 (3) dt.09-05-2018 2/2 anticipatory bail stating that case diary shows that huge quantity of Doda and Mahua flower were recovered from the vehicles, as such involvement of the petitioner that he is owner of the vehicles cannot be ruled out.
Having heard both sides and in view of recovery of huge quantity of Doda and Mahua flower, I am not inclined to grant anticipatory bail to the petitioner. Petitioner should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by the order of this Court.
