The petitioner apprehends his arrest in Sugauli P.S. Case No. 115 of 2016 instituted for the offence under Sections 272 and 273 of the Indian Penal Code and Section 47(A), 47 (c), 47 (e) and 54 of the Bihar Excise (Amendment) Act.

It has been submitted that petitioner was not present at the spot. His name has been disclosed by Sukhdeo Manjhi and Sonu Sahni, who were arrested on the spot. It has further been submitted that petitioner is father of Sonu Sahni. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.

Case No. 115 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) Cr.P.C.
