JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-02-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Chhauradano P.S. Case No. 70 of 2005 for the offences punishable under sections 25 (1B) A, 26 and 35 of the Arms Act. On behalf of the petitioner it is submitted that in this case the police after completing investigation submitted final form against the petitioner finding the acquisition against the petitioner false, vide Annexure-3 to the supplementary affidavit, and thereafter cognizance was taken against the petitioner also and as such the petitioner deserves sympathetic consideration.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. Sri N.K. Pridarshi, Judicial Magistrate, Raxaul at Motihari in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
