The petitioner apprehends his arrest in connection with Ara Town P.S. Case No. 196 of 2020 for the offence punishable under Sections 341, 323, 325, 307, 504, 34 and 504 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the parties are of same village and both parties are having dispute of orchard and on account of that, an scuffle took place between them in which the informant party has received injury. Patna High Court CR. MISC. No.135 of 2021(3) dt.27-10-2021 2/2 question has already been filed by the petitioner which is still pending before the D.C.L.R. Learned counsel for the petitioner further submitted that the co-accused, Dablu Sharma, has already been granted anticipatory bail by the court below itself and the case of this petitioner stands on better footing to the co-accused. Hence, the petitioners may be granted the privilege of anticipatory bail. Learned A.P.P. for the State has, vehemently, opposed the prayer for bail of this petitioner. Considering the facts and circumstances of the case, let the, above named, petitioner in the event of his arrest or surrender before the court below within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Ara Town P.S. Case No. 196 of 2020 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
