2. The present writ petition has been filed against the order dated 30.06.2015 passed by the Sub-Divisional Officer, Sadar, Gaya (respondent no. 2) whereby and whereunder the petitioner's P.D.S. Licence bearing No. 34/2007 has been cancelled; and for connected reliefs.

3. Having regard to the nature of the prayer in the writ petition, this Court finds that the petitioner has directly approached this Court without availing the statutory remedy by way of appeal against the impugned order.

4. The writ petition accordingly stands disposed of with

Patna High Court CWJC No.12175 of 2015 dt.18-08-2018 liberty to the petitioner to prefer an appeal before the District Magistrate, against the impugned order, if so advised.

5. It is made clear that in case such an appeal is filed, the concerned authority would have regard to the present proceeding being pursued by the petitioner while considering any issue relating to condonation of delay, if applicable.
