JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner, learned counsel for the Electricity Board and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Dehri Dalmianagar P.S. Case No. 197 of 2016 ( G.R. No. 368 of 2016), registered for the offences punishable under Sections 147, 149, 341, 323, 307, 353, 506, 379 of the Indian Penal Code. Allegedly, when the informant being Junior Engineer was returning after making raid at the premises of Ravindra Singh and Sudama Singh. Ravindra Singh, Sudama Singh, petitioner and other caught the officials of electricity department and abused and assaulted them, resulting, blood started coming from beneath right ear, other official also received injury, any how the informant and other succeeded in fleeing away.

Patna High Court Cr.Misc. No.5964 of 2017 (2) dt.22-02-2017 2/2 case Ravindra Singh and Sudama Singh have already been allowed pre-arrest bail after depositing loss amount of electricity department and the petitioner without any fault is apprehending his arrest.

The learned counsel for the electricity department opposes the prayer of pre-arrest bail by submitting that on vital part the injury has been caused.

In the facts and circumstances as stated above, considering that other co-accused Rabindra Singh and Sudama Singh have already been granted bail and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri Rohtas at Sasaram, in connection with Dehri Dalmianagar P.S. Case No. 197 of 2016 (G.R. 368 of 2016), subject to the conditions as laid down in section 438(2) of the Cr.P.C.
