====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 13-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Keshariya P.S. Case No.283 of 2012 registered under Sections 304(B) and 201/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the prayer of the petitioner for grant of bail was rejected twice vide orders dated 21.03.2014 and 20.05.2015 passed in Criminal Misc. Nos.35140 of 2013 and 45348 of 2014 respectively but earlier while rejecting the bail prayer of the petitioner vide order dated 20.05.2015 passed in Criminal Misc. No.45348 of 2014, this Court directed the trial court to conclude

No.10771 of 2016 (3) dt.13-04-2016 2/2 the trial within a period of six months and observation was made that if the trial is not concluded within the aforesaid period, the petitioner would be at liberty to renew his prayer for bail after six months. Now, more than six months have been elapsed after passing of the order dated 20.05.2015 passed in Criminal Misc. 45348 of 2014 rejecting the prayer for bail of the petitioner but the trial of the petitioner is still pending. The petitioner being the husband of the deceased is in custody 12.11.2012. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 6th Additional Sessions Judge, East Champaran at Motihari, in connection with Keshariya P.S. Case No.283 of 2012.
