Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-07-2021 Heard Mr. Bishweshwar Ram, the learned counsel for the petitioners and Mr. Mohammed Arif, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Khagaria (Gangaur) P. S. Case No. 818 of 2019 (G.R. No. 3214 of 2019), instituted for the offences under Sections 341, 323, 504, 379, 307 and 34 of the Indian Penal Code.

It has been alleged in the F.I.R. that the petitioners were members of the mob. Other accused

Patna High Court CR. MISC. No.1300 of 2021(2) dt.08-07-2021 2/3 persons are alleged to have assaulted the son of the informant and others. So far as the petitioners are concerned, it is absolutely clear from the allegations made in the F.I.R. that they are only members of the mob.

Regard being had to the afore-stated facts and taking into account that petitioner no. 1 has also filed a complaint case against the informant and others of this case, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P. S. Case No. 818 of 2019 (G.R. No. 3214 of 2019), subject to the conditions as laid down under Section 438
