The petitioners seek bail in anticipation of their arrest in connection with Dariyapur P. S. Case No. 265 of 2020, dated 06.08.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 302, 504 and 506 of the Indian Penal Code.

The accusation in the F.I.R. is that one person

The learned advocate for the petitioners has submitted that 35 persons have been named in the F.I.R. including the petitioners and 10 to 15 unnamed persons also are alleged to have committed the occurrence. Some of the accused persons have been specifically attributed with the weapon and the assault. So far as the appellants are concerned, except for their being named in the F.I.R., there are no other accusation against them.

Considering this aspect of the matter, this Court vide order dated 09.07.2021 called for the casediary and granted provisional bail to petitioner no. 2, who is a lady.

There is no material even in the investigation papers to connect the petitioners with the offence. Regard being had to the afore-stated facts, the provisional bail granted to petitioner no. 2 is, hereby, confirmed.

She shall remain on the same bail-bonds.

The petitioner no. 1, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 13th , Saran at Chapra, in connection with Dariyapur P. S. Case No. 265 of 2020, subject to the conditions as laid down under Section 438
