JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and except one motorcycle and one mobile set, nothing has been recovered from conscious possession of the petitioner. Learned counsel for the petitioner submits that seized motorcycle does not belong to the petitioner whereas the seized mobile belongs to the petitioner. It is further submitted by him that except confessional statement of co-accused, there is nothing against the petitioner, who happens to be a student and does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.5641 of 2016 (2) dt.16-02-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Gopalganj in connection with Hathua P.S. Case No. 198 of 2015.
